Abstract
Examines the use of short term prison sentences in Scotland, including their proportion of all prison sentences, the rise in their use , the types of offender to whom they apply. Questions their usefulness when compared to community sanctions. Looks at the barriers to the formation of a clearly articulated sentencing policy. Offers suggestions for how a sentencing policy could be developed, beginning with the Sheriff Court and involving the judiciary in the formulation of guidelines.
