Abstract

This important Act completely redesigns Scots law on parental responsibilies and parental rights, guardianship and the administration of children's property. In addition, the Children's Hearing system is re-enacted with a number of significant improvements. The coverage of this text is comprehensive, and now includes: custody and access, replaced by "residence" and "contact"; the law of guardianship reshaped and clarified; local authority duties specified; Place of Safety Orders replaced by Child Protection Orders, with new review and appeal mechanisms; exclusion orders; local authority parental rights resolutions, replaced by court process and Parental Responsibility Orders.
