Abstract

This Act redesigns Scots law on parental responsibilities and parental rights, guardianship and the administration of children's property. In addition the children's hearing system is re-enacted with a number of important improvements. The book provides an accessible commentary on the Act, highlighting the important changes, identifying the derivations of the major provisions, giving practical guidance in the layout of the Act and interpretation of the various provisions. Coverage includes: Court Orders, including residence and Contact Orders; the law of guardianship reshaped and clarified; local authority duties specified; Child Protection Orders and their review mechanisms; Exclusion Orders and Assessment Orders; and local authority Parental Rights Resolutions replaced with court process anD Parental Responsibility Orders.
