Abstract

Examines Reynolds v Henry (UT (SC)), allowing a tenant's appeal against the First-tier Tribunal's refusal of her application for a wrongful termination order (WTO) under the Private Housing (Tenancies) (Scotland) Act 2016 s.58 in circumstances where she vacated the property because of the landlords' apparent plan to sell it, but no offers were accepted and the property was ultimately re-let. Discusses the four-stage test for determining whether a WTO should be granted.
