Abstract
The Prisoners Control of Release (Scotland) Act 2015 means that long-term prisoners sentenced on or after February 1st 2016 will no longer have to be conditionally released under supervision at the two-thirds point of the sentence. While this has now been in place for a while, it is one of the biggest changes in recent Scottish criminal justice history, with serious consequences for many prisoners. The newspapers reported ‘an end to automatic early release’, but this is misleading in several ways.
