Abstract
With many of Scotland’s councils declaring a housing emergency and the Scottish Parliament doing likewise, prospective tenants can feel the pressure when it comes to securing a private let. Meanwhile, owners of suitable accommodation may seek to capitalise on this situation, but there are rules which seek to prevent unscrupulous landlord behaviour from going too far, covering any payments required or received in connection with the grant or transfer of a tenancy. A recent case at the Housing and Property Chamber of the First-tier Tribunal for Scotland serves as a timely reminder of the relevant regime.
