Abstract
The author considers the calculation of legal rights in a situation of intestacy where a deceased party is survived by a spouse or a civil partner, in light of statutory intervention following the enactment of the Succession (Scotland) Act 1964. That reform may have inadvertently affected entitlements to the deceased party's estate.
