Abstract

Comments on McLellan v Anderson [2026] SC DUNF 85, indicating that the learned Sheriff erred in finding that there were ‘good grounds to pierce the corporate veil' in that case. There was ultimately, however, no need for the Sheriff to get embroiled in the mysteries of company law: the ordinary rules of law relating to reparation all but necessitated the ultimate finding that the respondent was personally liable to the claimant.
