Abstract

By virtue of section 98 of the Employment Rights Act 1996, the “conduct” of an employee can give rise to a potentially fair reason for dismissal under the Unfair Dismissal rules detailed in part X of that Act. The type of conduct that can give rise to a potentially fair reason for dismissal – understood to be misconduct – has been elaborated on in case law and includes acts such as wilful disobedience of a managerial order, breaches of the employment contract, incompetence and poor performance.
