Abstract

On September 11, 2003, the Cartagena Protocol on Biosafety came into force, whose main objective is the regulation of international trade in living modified organisms. On the same day in Cancún, Mexico, the fifth ministerial meeting of the World Trade Organization. Some months before, on May 13, 2002, the United States of America, together with Canada and Argentina, raised before the WTO the illegality of the de facto moratorium of the European Community on the LMOs until arriving on August 18. 2003, to request the creation of a panel in accordance with the WTO dispute settlement mechanism on this matter.
