Abstract
Against the backdrop of Brexit, the Court of Appeal of the United Kingdom issued its first judgment on the EWC Directive 2009/38/EC on 30 June 2023. The case of EasyJet PLC v European Works Council (EWC) of EasyJet mainly concerned whether European Works Councils (EWCs) would continue to exist in the United Kingdom after Brexit. The Court of Appeal's affirmative judgment raises important questions for future EWC activity in the United Kingdom post-Brexit. For the discussion of the EasyJet judgment, this note is structured as follows: Section I explains the legal situation and the relevant changes in the wake of Brexit. Section II summarizes the facts and the decision. Section III summarizes the importance of the case for the future activity of EWCs in the United Kingdom.
