Abstract

Comments on the Adoption and Children (Scotland) Act 2007, and in particular problems associated with: (1) the revised grounds for dispensing with parental consent to an adoption under s.31(3)(e) where it is in the welfare of the child to do so; and (2) permanence orders, introduced to replace freeing orders and parental responsibilities orders, and how they are to interact with supervision requirements and also relating to the precedence of orders. Feels that the Act has not simplified adoption law in Scotland.
