Description
This paper examines non-jury trials (NJTs) for terrorism offences in Northern Ireland in light of the requirement under the Strand 3 of the GRA 1998 for normalisation of security arrangements in NI. The first section will consider the justifications for NJTs, historically and contemporarily, and reasons for their persistence. The second section will consider how NJTs deviate from the ‘normal’ justice system and the challenges they present to constitutional norms. The final section will offer four alternatives, arguing that the current system should be abolished, with reliance instead on the system under the Criminal Justice Act 2003 Pt 7.
